Self Represented Parties in Colorado's Water Courts
This research project aims to better understand the role of self-represented parties (pro se) in Colorado's water courts. We hope to evaluate the obstacles that self represented parties face throughout the process; any challenges their participations causes for the courts, administrators, attorneys, and other parties; and any possible solutions.
As part of our research, we are collecting information from a wide variety of actors in the water court process, from judges and referees to clerks and division engineers and water commissioners. Most of all, we want to collect feedback from water rights holders who have participated in water court representing themselves (either as applicants or opposers). We are interested in hearing about this experience, what it was like, what was challenging or frustrating about it (or what was positive). We would also like to hear from individuals who considered representing themselves in a water matter, but decided either to retain representation to not participate at all. We would be interested in better understanding the factors that went into this decision.
The outcome of this research will be a law review article that provides a legal overview and summarizes the qualitative data collected about self represented parties in Colorado's water courts.
We invite willing participants to fill out a survey. To participate, you must be 18 years or older. This survey is voluntary and will take approximately 30 minutes.
We are also seeking individuals would be interested in participating in future focus groups about these issues or who would like get updates on this research project. Click here.
