TITLE OF STUDYSelf-Represented Parties in Colorado Water Court

Josh Boissevain, Student, University of Denver Sturm College of Law Professor Tom Romero, Faulty Supervisor, University of Denver Sturm College of Law PROCEDURESParticipation in this study consists of complete a survey answering a number of questions regarding your experiences with self-represented parties participating in water court, the challenges you see, and possible solutions to improve the process. It will take approximately 30 minutes to complete the survey.
Before you begin, please note that the data you provide may be collected and used by Qualtrics as per its privacy agreement. This research is only for U.S. residents over the age of 18. Please be mindful to respond in private and through a secured Internet connection for your privacy. Your confidentiality will be maintained to the degree permitted by the technology used. Specifically, no guarantees can be made regarding the interception of data sent via the Internet by any third parties. |
PURPOSEYou are being asked to participate in a research study. The purpose of this research is to better understand the obstacles self-represented parties face throughout the Colorado water courts and water rights administration process; any challenges their participations causes for the courts, administrators, attorneys, and other parties; and any possible solutions.
RISKSPotential risks and/or discomforts of participation in the anonymous survey are low because we will not ask you to provide personal information. If you voluntarily provide personal information, potential risks include social, reputational, and unforeseeable risks because your personal and professional opinions about court and administrative processes will be published for public consumption.
BENEFITSPossible benefits of participation include results that lead to better protections, access to justice, and improved judicial efficiency. Benefits also include a better understanding of how self-represented parties fit into the broader water court and administrative processes.

VOLUNTARY PARTICIPATIONParticipating in this research study is completely voluntary. Even if you decide to participate now, you may change your mind and stop at any time. You may choose not to answer any survey question for any reason without penalty or other benefits to which you are entitled.
CONFIDENTIALITYThe researcher will keep your information safe throughout this study. The survey is anonymous and will not ask you to list any personal information that will link the results back to your identity. Your individual identity will be kept anonymous when information is presented or published about this study. Results of the survey will be maintained on both the Qualtrics encrypted database and researcher’s password protected computers.
However, should any information contained in this study be the subject of a court order or lawful subpoena, the University of Denver might not be able to avoid compliance with the order or subpoena. The research information may be shared with federal agencies or local committees who are responsible for protecting research participants. |
